Yung Tito ko po kasi nasa abroad, before sya bumalik sa ibang bansa noong February 2018, iniwan nya sa akin ang kotse nya. Tapos po 2 months syang delayed sa payment sa bank kaya may pumunta na sa bahay para ipagbigay alam na kailangan ng hatakin ang kotse para hindi sya maidemanda. Ang tanong ko po, kapag ba hindi na surrender sa alotted time frame yung kotse, maaari ba akong makasuhan kasi sa akin iniwan o yung Tito ko yung liable doon? Salamat po.

Ang tito mo talaga ang party to the contract so siya ang dapat kakasuhan kung sakali man ng bank. However, dahil nandoon siya sa ibang bansa walang jurisdiction ang ating korte sa kanya. Maari naman ang company ay hindi nalang magpafile ng case at magpapadala nalang ng demand letter to repossess the car so dapat isauli sa kanila ang car at a certain period. Ngayon, dahil ang tito mo ay wala dito kukunin nila kung kung saan ito presently matatagpuan. Kailangan mo itong ibigay dahil hindi naman ito sa iyo at dapat ipaalam mo ito sa iyong tito at pinakaimportante sa lahat may dokumento kang hawak na kinukuha nanila. Kung ayaw mong ibigay maaring makasuhan ka nila dahil you are not a privy in this contract but if you can secure a special power of attorney from your tito to negotiate it with the bank para hindi naman marepossess mas mabuti. Regularly, the bank would grant extension naman po basta makipagsettle lang sa kanila. Since ang iyong Tito ay nasa ibang bansa dapat duly notarized ang document doon sa ating embassy bago niya ipadala sa iyo ang Special Power of Attorney.
