Nagfile ng kaso laban sa police dahil walang sustento sa anak, pwede pa ba iurong?

Nag file ako ng complaint against a police officer which is tatay ng anak ko, and kami nag kasundo sa sustento kaya gusto ko syang ipadismiss so umabot kame sa summary hearing ng IAS-legal department at magpapasa na dapat ng positioning paper para iforward na kay Chief PNP. Pero bago kame mag pasa ng paper nagkasundo na kame sa amount of support para sa bata kaya gusto ko ng iurong ung kaso sabi ng prosecutor na naging abogado ko din during the hearing kausapin ung summary hearing officer at magsubmit ng affidavit of desistance. Pero sabi ng prosecutor kahit pa iatras ko un ang PNP na ang magiging complainant. Please help me kung anong dapat kung gawin

Pasensya na po hindi ao expert sa admin case pero ang maipapayo ko lang kung gusto po ninyong idismiss ang case you have to execute an affidavit of desistance at ifile po ninyo ito sa hearing officer. Since walang pa resolution maaring madismiss pa ito. Sa korte kasi ipapatawag pa ang complainant na nag execute ng affidavit of desistance. So maybe in admin case you will be given the chance to explain kung bakit gusto mong i dismiss ito. In short kahit pa PNP na ang magiging complainant you still need to execute affidavit of desistance to support the motion to dismiss.

Hello maam, maraming salamat sa pag reply. Nag tanong dn po ako sa kakilala ko na nsa korte sabi nya pag nag submit na ng affidavit of desistance dapat iwithdraw na ung case.. pero bakit maam ung sabi ng prosecutor kahit pa mag submit ako ng affidavit of desistance tuloy pa rin ang kaso.. ang magiging complainant na ay ung PNP na mismo nd na ako at maaring ma dismiss ung father ng baby ko.. dahil ba may kaso sya na grave misconduct kaya itutuloy parin ng PNP?

In admin case , it has its own rules maaring ipagpatuloy nila ito ngunit usually sinisettle naman ng mga hearing officer lalo na if not willing na ang complainant. Ang importante diyan nakapag execute na ng affidavit of desistance ang complainant.

Sa tue po off ko kaya pupunta ako ng crame pra isubmit ung affidavit of desistance.. dapat maam nung june 29 ung positioning paper pero tinawgan ko lang ung prosecutor ko nung june 28 na nd na ako magsusubmit at i-uurong ko na ung kaso.. ung respondent lang at atty nya ang nakipag usap sa summary hearing officer kasi may work po ako nung 29 maraming salamat po ulit maam sna marami pa kayong taong matutulungan ng l
