Land Title with Encumbrances from NHA

Ako about sa house and lot na binibenta sa amin. Nung nakita ko po ung title may nakalagay po sa likod ng encumbrances;


"Except by Hereditary succession, herein Lot shall not be alienated, transferred or encumbered within 10 years from the date of issuance of the TCT (June 2017) without the prior written consent and authority from NHA. Every conveyance shall be subject to repurchase by the Vendee or his legal heirs within a period of 10 years from the date of conveyance. In case the vendee fails to exercise his reight to repurchase, the Vendor has the right to repurchase the same within a period of one (10) year from the expiration of the five year period."

as of now po ay marami na po ari-arian ung nagbebenta at ndi na po kasi nia nagagamit ung house and lot na yan.

may chance po bang mabili ko po ito at ma transfer ang title sa akin? pede po bang mapa cancel ung encumbrances sa NHA?

or pede pong mga initiate na ng deed of absolute sale, process na ung CAR from BIR at Tax from munisipyo?

Hi, malinaw na nakasaad ang prohibition sa pagbibinta, pagtatransfer o pangsasangla ng sinasabing house and lot within 10years from issuance of title starting June 2017 kung walang permiso o authority ng NHA, maliban lamang kung masusunod mo ito as legal heirs ng nagbibinta. So, pwede naman syang bilhin ngunit kailangan ninyong humingi ng permisyon from NHA. Aside from that, ang property na ito ay maaring bilhin uli ng nagbinta sa inyo o ng kanyang heirs within a period of 10years from sale. So dapat ninyong makipag ugnayan sa NHA bago ninyo bilhin ito. Hindi agad matransfer ang Titulo sa inyo dahil mayroon pang 1o years na pwedeng bilhin uli ng nagbinta/heirs o ng NHA. So, kung bibilhin talaga ninyo ito dapat ipa register ang Deed of Absolute sale sa Registry of Deeds kahit hindi pa muna maprocess ang pagpapatransfer ng titulo sa inyong pangalan. Maaring humingi ng tulong sa NHA para sa karagdagan impormasyon tungkol dito bago kayo magbayaran sa may ari ng lupa.
