Pwede na ba ako ulit makasal after divorce? Can I get married again after divorce in Canada?

Nagpakasal po kami noong June 16 2005 at naghiwalay kami ng April 29 2007 after noon hindi na kami nag sama. Nasa canada na po siya ngaun at doon na nag tatrabaho, nag file po siya ng divorce doon at nagpadala siya ng papers saken dito para pirmahan ko. Pareho po kaming filipino at sa pinas po kami kinasal. Gusto ko pong malaman ay kung pwede na din ba ako magpakasal na ulit sa pilipinas after ng divorce? And kung may mga process pa po ba akong dapat gawin? Maraming salamat po



Topic: We got married in June 16, 2005, and we separated April 29, 2007. After that, we have not stayed together anymore. She is now in Canada and working there. She file a divorce there and she sent papers so that I can sign them. We are both Filipinos and we were married in the Philippines. I just want to know if I can get married again after the divorce? Are there still any processes to be done before I can do so?

Naku, masalimuot ang sagot sa masalimuot na tanong na ito. Pilipinas lang at Vatican ang dalawang bansa sa mundo na hindi nag-a-allow ng divorce. Kung kayong dalawang mag-asawa ay sa Pilipinas kinasal, at kayo ay pawang mga Pilipino, bawal sa inyo ang mag-divorce.

I am assuming na permanent legal resident na ang dati mong asawa sa Canada kaya siya'y naka-kuha na ng divorce. Hindi pa siya Canadian citizen. So, he is still governed by Philippine laws. Pero, dahil sa siya'y naka-kuha na ng divorce mula sa isang Canadian court, sa ilalim ng mata ng batas ng Canada, siya'y malaya nang magpa-kasal muli.

Ikaw na lamang ang may problema. Una, ikaw ay andito sa Pilipinas. Para ikaw ay magpakasal dito sa Pilipinas, kakailanganin mo ng Certificate of No Marriage mula sa NSO. Kahit na ipa-tala mo pa sa NSO ang divorce decree na issued ng Canada court, ang divorce ay mabisa lamang para doon sa dati mong asawa, kasi, immigrant status na siya sa Canada. Ikaw na Pinoy pa rin ang citizenship at residence ay naka-tali pa rin sa kasal mo. Iyan ang hypocrisy at absurdity ng mga batas ng Pilipinas tungkol sa divorce.

Bakit hindi mo subukan na ipa-tala sa NSO ang divorce decree na authenticated mula sa Canadian Embassy? Kapag tinanggap nila ito, subukan mong mag-apply ng panibagong marriage license. Kasi, bago sila mag-issue ng bagong marriage license, magse-search sila sa Index of Marriage. Lalabas ngayong ang kasal ninyo dati, kaso, may asterisk na ito at attachment -- yung divorce decree. Tignan mo kung uubra.

Pero, sa totoo, hanggang sa hindi binabago ang ating mga batas, wala, malaya na iyong dati mong kabiyak, pero, ikaw, you are still stuck till death sa marriage na wala nang saysay. Unfair, ano? Sisihin mo ang Katolisismo sapagkat sila ang may kasalanan dito. I think lang na hypocritical ang pagbabawal sa diborsiyo dito sa Pinas -- lahat naman halos ng mga nagpapakasal ay naghihiwalay din (exception na iyong mga nagsasama hanggang sa kamatayan). Ito din ang dahilan kung bakit ang mga mayayaman ay hayagang nabubuhay na may mga babaeng binabahay (think of Dolphy and of Erap) -- dahil nga sa walang diborsiyo sa Pilipinas. Ito din ang dahilan kung bakit tumataas ang mga bilang ng mga couples na nagsasama bilang mag-asawa kahit walang kasal-kasal. kasi, kung mag-hiwalay sila, walang sakit ng ulo tulad ng ganito, na hindi ka makakilos dahil sa ang mga papeles mo ay hindi mo mai-ayos. Panahon pa ng mga Kastila ang mga moralidad ng mga tao sa Pilipinas at ito ay nakaka-apekto na sa mga karapatan ng mga tao na malayang maki-sama, magpa-kasal at mag-diborsiyo kung nais nila.

Puede naman na kung ikaw ay maging immigrant din sa ibang bansa, ma-recognize na ang divorce ninyo ng iyong dating asawa at ikaw ay maaari nang magpakasal pero sa ilalim ng mga batas ng country kung saan ka nag-immigrate.
