Medical debt-Nagkaroon utang sa hospital, titulo lupa collateral

Atty, nagkaroon kami ng utang sa ospital at titulo ng lupa ang ginawang collateral kasama ng promisary note . Naghuhulog naman kami kada buwan kaso maliit lang. Naginform ang ospital n ililipat nila ang titulo ng lupa sa bangko parang s bangko na kme may utang. Pwede ba ilipat ng ospital ang titulo ng lupa sa isang bangko na hindi kame pumapayag?



Topic: Attorney, we owed/incurred medical debt in the hospital that we could not pay, so we used our land title as collateral with a promissary note. We paid installments monthly, but only small amounts. The hospital informed us that they would transfer the loan with the land title collateral to a bank, so that we would in effect have a loan in the bank. Can the hospital move our land title to a bank without our permission?

Naku, I cannot give you a definite opinion on this. Under the law, ang isang promissory note ay isang negotiable contract. Ibig sabihin ay puedeng ibenta ng ospital ang promissory note sa banko para bayaran sila ng banko at ang banko na ang maniningil ng utang.

Pero, iyon ay isang promissory note. Iyong titulo ng lupa, hindi ko masagot -- una, mayroon ba kayong pinirmahan na mortgage doon sa inyong pagkaka-prenda ng lupa? Iyon bang promissory note o mortgage ay naka-annotate sa likod ng titulo?

Pinaka-mainam ay humanap kayo ng abogado upang ma-evaluate ang mga papeles ninyo (lalo na iyong promissory note na inyong pinirmahan). At saka, isa pa, nakanino naka-rehistro ang lupa? Doon ba mismo sa nangutang? O sa ibang tao?
