Marriage without annulment, is it possible?

10 years na po ako hiwalay sa asawa ang dahilan ng paghihiwalay ay nabuntis sya ng ibang lalaki habang nasa abroad ako. Gusto ko na po magpakasal ulit sa kinakasama ko ngayon. Nakausap ko na ang ex-wife ko na hindi sya gagawa ng anu mang hakbang para guluhin ang bago kong buhay. handa din sya mag bigay ng sworn statement na katunayan na hindi na kami nagsasama. Possible po ba ako makasal kahit hindi ako mag file ng annulment kahit sworn statement lang ng ex-wife ko?



Topic: My wife and I have been separated for 10 years now and the reason is because she got pregnant by another man while I was abroad. I would like to get married again to my current partner. I've already talked about this with my ex wife and she agreed that she would not oppose. She is also willing to provide sworn statement to prove that we are no longer living together. Is it possible to get married again even without filing for annulment?

Naku, sorry. Ang marriage ay isang pribadong kasunduan s pagitan ng dalawang taong nag-iibigan, oo, pero ang gobyerno at lipunan ay may interes kung kaya't hindii basta-basta puedeng buwagin ng mga tao ang kanilang sariling mga kasal.

Ang may karapatan na bumuwag nga mga kasal ay mga husgado lamang. So, dahil sa kayo'y legal sa kasal, tanging ang husgado laang ang makapagde-deklarang ang inyong kasal ay nabuwag na. Ang mga pribadong deklarasyon, kasunduan at mga kontrata sa pagitan ng dating mag-asawa na naglalayong paghiwalayin sila ay walang bisang legal.

So, hindi ka puedeng ikasal ulit. Magpakasal ka man, kahit na ano'ng oras, ang datin mong asawa ay maaaring magsampa ng habla laban sa iyo for bigamy o kaya naman ay concubinage. So, husgado lamang ang puedeng magpawalang bisa sa inyong kasal.

Sinilip mo na ba sa NSO kung rehistrado ang kasal mo sa una mong asawa? Baka kasi hindi naman rehistrado --eh, di malaya ka kasi, sa harap ng batas, kung hindi rehistrado yung una mong kasal, hindi ka kasal. Wala nang kailangan pang buwagin. Malaya ka. Tignan mo din. Who knows, you might be lucky!
