Hello po! Kasal na po ako, asawa ko U.S citizen siya. Dito kami kinasal sa U.S, pero bago ako may asawa siya divorce na sila dito sa U.S. Pwede po ba yun na dito sila ng pa divorce kahit sa pinas sila kinasal? Ang babae nung kinasal sila Pilipino Citizen pa pero nung ng divorce sila U.S citizen na. Matatawag ba ako na Legal Wife? Kahit hindi nila ni process sa pinas?

Topic: I have a husband who is a U.S. citizen. We were married here in the U.S., but he was married before to another woman from the Philippines, but they've already divorced here in the United States. Is it possible for them to get divorced here in the U.S. even if they were married in the Philippines? Can I be considered the legal wife?

Naku, ang tawag sa problemang ganito ay 'conflict of laws'. kaya conflict, magkaka-iba ang mga batas ng pinag-mulang bansa at ang kasalukuyang kinabibilangang bansa.

Ang rule kasi ay, kung ang isang tao ay malayang magpakasal sa bansa kung saan siya citizen, malaya siyang makapag-papakasal. ibig sabihin nito'y kung sa US ay ang US citizen ay malayang magpakasal pagka't siya'y diborsiyado na mula doon sa una niyang asawa, legal ang kanyang kasal.

Ang problema, ang kasal na nauwi sa diborsiyo ay isang kasal na dito sa Pilipinas ginanap sa pagitan ng dalawang Pilipino. Sa atin dito sa 'Pinas, walang divorce, so, ang divorce ay hindi isang legal na paraan upang ang isang kasal ay wakasan sa paraang legal.

So may anomalous situation ngayon: ang unang kasal ay may-bisa pa sa Pinas, pero, sa US, ito'y napawalang-bisa na. Ang pangalawang kasal sa US ginanap ay may-bisa sa US, pero sa Pilipinas, ito'y walang bisa.

Ang iyong tanong ay, 'legal wife' ba ang pangalawang asawa? (Parang telenovela,ano?) Oo, siya'y legal wife pero, sa US lamang. Sa Pilipinas, siya'y hindi legal wife.

Ang maaari nilang gawin ay ayusin sa Pilipinas upang ma-recognize ng Pilipinas ang divorce noong dalawang Pilipino na sa kalauna'y naging US Citizens na. Kailangan ng certified true copy ng order or decree of divorce at noong judgment. Kailangang ipa-authenticate sa Philippine Embassy. O ipa-authenticate sa US Embassy dito sa Pilipinas. Tapos, magsasampa ng kaso sa Pilipinas para ang diborsiyo sa US ay kilalanin.

Kailangan ng abogado para dito. Sana'y nasagot ang iyong katanungan.
