Lumapit sa magulang ko yung mag asawa na may ari ng lupa para umutang ng pera dahil mareremata sa banko yung bahay at lupa nila. Sinabi ng may ari na lupa na lang ibabayad nila doon sa pagkakautang nila (dahil malaki yung lupain nila). Nai processo namin agad yung XX sqm na kapalit ng inutang nila at ngayon ay nasa pangalan ko na. Dumating yung time na nangailangan ulet sila ng pera kaya nagpapapirma ang nanay ko sa kanila na kumuha sila ng "PhpXXX,000.00 kapalit ng lupa" at pirmado ng Mr. (namatay na yung mrs nung may ari), may ibang kasulatan sila na street name at subd lang nakalagay at may iba na halaga lang ang natanggap nila at walang information kung para saan yung pera. Nasa processo na kami ng pag aayos ng deed of sale at dahil sa pandemic at nawalan ng hanap buhay ang magulang ko, nag usap usap sila kasama ang mga anak, tatay (may ari ng lupa) at ang kapatid nito kasama ang mga magulang ko na sila n lang mag papaayos ng deed of sale kaya hiningi sa amin ang original title at yung copy ng deed of sale na pipirmahan nila pati yung copy ng survey ng lupa. 11 weeks ago namatay ang tatay (may ari ng lupa) at sinabi ng anak na kausap namin (na mag aayos ng titulo) na dahil sa walang deed of sale di nila ibibigay ang lupa pero babayaran nila ang pagkakautang na Php XXX,XXX.00 sa loob ng 3 taon.

May habol pa po ba kami kung ilalaban namin yung mga naiwan na papel sa amin na pinirmahan ng tatay (na may ari ng lupa) nila? salamat po

Pwede naman po kaya lang sa korte na po kayo hahantung if talagang hindi kayo magkaayos po nito. Lalo na if ayaw po nilang mag execute ng Deed of Sale po para sa property na nabili po ninyo. Mas mabuti po na komunsulta po kayo ng abogado ipakita po ninyo ang anumang dokumentong hawak po ninyo para naman mabigyan kayo ng tamang advise po. Importante sana po na in possession po kayo sa property plus the document in this way medyo strong po ang claim of ownership po ninyo.
