I want to know kung may bayad po ang remaining days ko. Tatangalin po ako ngayong October 31, pero ang end of contract ko po ay November 25. Need advice asap may separation pay ba ako? Sabi po wala daw po akong separation day kasi pang biglaang tanggal po yun at ang makukuha ko lang po is yung sahod at 13 month pay tinanggal po nila ako ng walang dahilan.
Tatanggalin po nila ako sa October. 31 pero ang end of contract ko po ay November 25. Wala naman po akong nagawa na masama or maka broke ng rules. Maganda naman po ang performance ko pero nirate po nila ako ng mababa at dahil doon tatangalin nila ako. I think hindi sapat na reason yun para tanggalin ako pero po wala na po ako magagawa at yung seperation, remaining days, 13th month pay at kung may leave po ako (parang wala sila binigay sakin) nalang po ang pag asa ko.
May separation pay ba ako at babayaran ba nila remaining days ko?

Hindi mo sinabi kung anong ilang taon ka ng nagtatrabaho at kung anong reason na tatanggalin ka nila. Kung tatanggalin ka at casual ka palang wala kang makukuha na separation pay. Kung ilang years ka ng nagtratrabaho at tatanggalin ka nila dahil may sakit ka nakahahawa, losing yong company or kaya para narin makapagsave ang company may mga installation saving devices na ginagamit instead of mga tao mismo ang ginagawa sa ganitong reason magbibigay sila ng separation. Ngunit kung tatangalin ka dahil may mga nilalabag ka sa company or ginawang paglabag katulad ng serious misconduct, abandonment sa trabaho at maraming pang iba then you cannot expect separation pay ngunit kailangan maimbestigahan ka muna tungkol dito. So kailangan mong kausapin ang HR ninyo or kung gusto mo pwede po kayong lumapit sa NLRC/DOLE para sa ibang katanungan po.
