Nakabili po kami ng bahay at lupa sa isang kamag anak. pero hinde po niya sinabi sa amin na yung poso negro ng nasabing bahay eh nasa ibang lote nakalagay. ?

Ngayun po ay pinapaalis na niya yung connection ng tubo doon na galing sa nabili namin bahay. me habol pa po ba kami sa pinagbilhan namin? ano po kaya ang pwede namin gawin? kasi po dagdag gastos po kasi kung magpapagawa pa kami eh dapat kasama na yun nung nabili na namin ng bahay at lupa.

Una po, mahalagang suriin ang kasunduan o Deed of Sale na inyong pinirmahan noong binili ninyo ang bahay at lupa. Narito po ang ilang hakbang na maaari ninyong gawin:

Suriin ang Kasunduan – Kung hindi nakasaad sa Deed of Sale na may access ang bahay sa poso negro sa ibang lote, maaaring ituring itong concealment of a material defect o pagtatago ng mahalagang impormasyon, na maaaring maging basehan para sa legal na aksyon.

Makipag-usap sa Nagbenta – Subukang makipag-ayos muna sa inyong kamag-anak upang pag-usapan kung may posibilidad na manatili ang koneksyon ng poso negro, o kung maaari silang tumulong sa gastos ng paggawa ng bago.

Legal na Reklamo – Kung hindi kayo magkasundo, maaaring ipatingin ito sa isang abogado upang malaman kung may ground kayo for rescission of contract (pagpapawalang-bisa ng bentahan) o damages (bayad-pinsala) dahil hindi ito naipaalam sa inyo bago bilhin ang bahay.

Pagtatayo ng Sariling Poso Negro – Kung wala nang ibang paraan, maaaring kailanganin ninyong magpagawa ng sariling poso negro sa loob ng inyong lote. Maaari itong ipadaan sa inyong barangay o munisipyo upang malaman ang mga regulasyon at posibleng assistance.

Kasong Sibil (Civil Case) – Kung may sapat na basehan, maaaring magsampa ng kaso laban sa nagbenta dahil sa fraudulent concealment o breach of contract kung mapapatunayan na sinadya nilang hindi ipaalam ang impormasyon tungkol sa poso negro.

Sa madaling salita, kung may patunay kayo na hindi ito naipaalam noong pagbili ninyo, maaaring may legal kayong habol. Makipag-ugnayan sa isang abogado upang malaman ang pinakamagandang hakbang na maaaring gawin.
