May minana po na lupa ang aking ama sa kamya mga mgaulang. ito po ay naging pag mamay ari ng mag kakapatid ng aking lolo. naka tax declaration po ang lupa sa pangalan ng magulang ng aking mga lolo. 2 parte ng lupa ay napa tituluhan, ng walang extra judicial settlement ng mag kakapatid. anf nangyari po ngayon, ina angkin ng parehong partido (may ari ng lupa na may titolo) na ang kalahit ng kinatitirikan ng aming bahay ay sa kanila at gayun din ang kabilang kahati ay ina angkin din ng isa pang may ari ng lupa na may titolo. ang nangyari po kung susundin namin ang knilang mga sinasabi ay nawalan na po ng mana ang aking ama. ang bahay po namin ay nakatayo na sa lupang iyon na mag hihigit kumulang 50 years na. Ang may ari ng kabilang lupa na may titolo ay gustong ibenta ang bahay nila ngunit nais na isama ang bahay namin kasi wala naman daw itong titolo. sa ating batas, ano po ang hatian ng lupa kung ito ay pamana/ ma aari pa rin po ba nilang angkinin ang bahay namin kahit hindi naman an ito kasama sa titolo ng knilang lupa? kung aangkinin nila ang kinatitirikan ng aming bahay, papa ano po namin mahahabol ang minanang lupa ng lolo ko na siyang pinaman sa aking ama. sana po masagot ito. salamat

Sa ganitong situation kailangan na po ninyong kumuha ng isang abogado na mag assist po sa inyong claim po. You may try naman po sa PAO office baka naman they can accommodate or you may be qualified to avail of their free legal service. Sa nakikita ko you need to trace from the Original Title until the subsequent issuance of their separate respective title. You need to ask a copy of their supporting documents from the Register of Deeds or from the office of the Municipal Assessor as to how come they were issued a separate title without an Extrajudicial Settlement or kaya any form of legal document to support sa kanilang issuance of separate title. In the meantime you need to secure the Death Certificate of your Grandfather, the Birth Certificate of your father and his Death Certificate and your Birth Certificate to show your affiliation. You should present all those documents to the lawyer that you will soon consult para mas madali po niya itong maintindihan.
