Gusto ko sana itanong ang tamang proseso at pag papaligal ng last will and testament. Ganito po ang nangyari 11 yrs na po ako sa saudi at ganun din po katagal na tumutulong ako sa aking magulang bago po namatay ang aking ama hinabilin nya sa akin ang lupa at bahay at sinang ayunan naman yun ng aking ina. may dalawa po akong kapatid na tanggap din nila yung desisyon ng aking magulang. Sa ngayon po buhay pa aking ina, sapat na po ba ang verbal na pag uusap namin mag kakapatid upang i honor ang desisyon ng aming magulang or need pa gumawa ng last will and testament ang aking ina at ano mga requirments para maging ligal ang last will and testament na gagawin ng aking ina

Hi, unang-una ng namatay ang ama mo automatic ang ina mo at lahat kayong magkakapatid legitimate/illegitimate ay tinuturing na compulsory heirs sa lahat ng property na pag aari ng mga magulang mo. So hindi lang mama mo ang may ari niyan kundi kayong lahat na. Hindi sapat ang verbal lang mahirap kasing patunayan yan kong gusto mo nang magpapatitle sa property. Pwede namang hindi na last will ang ang gagawin. Dapat din walang utang na hindi nababayaran ang ama mo dahil maaring kunin ito ng pinagkautangan lalo na kung isinangla ito. Habang nabubuhay pa ang nanay at sa sinabi mo na payag lahat ng kapatid mo. Pwede nalang gumawa ng Extrajudicial Declaration of Heirs Settlement and with waiver of Rights. Ibig sabihin nito ito ay isang pagkilala sa mga heirs ng ama mo at pagpapaubaya sa kanilang mana para sa iyo. Lahat sila at ikaw ay pepirma nito. Ito ang gagamitin mo sa pagpatitulo ng bahay at lupa ayon sa pangalan mo. Maari kang kumuha ng abogado para gawin ito. Ito ay mas simple at praktikal gawin sa sitwasyon mo.
