Pending criminal case at MTC can reason for HDO?

Need a lawyer advise.
im currently applying abroad, i have pending criminal case at mtc and I'd like to know sakop ba ang mtc na nag iissue ng hdo? Upon departure kung makita ng BI agent na may pending criminal case rhru nbi database reason ba ito para d ka paalisin? Thank you po

As far as I know you can not leave our country if nag apply lang po ang complainant ng hold departure order lalo na dahil MTC case lang ito. Unlike if the criminal case is pending in RTC but still HDO order is needed para hindi po kayo makalabas. But with the technology nowadays, if I were you better settle the case before you leave maari kasing pagbalik mo may warrant of arrest na kayo dahil sa hindi po ninyo pagsipot sa hearing so by the time uuwi kayo mahohold din kayo at the airport.

Hi atty. Thankss for your response. Naabutan po kasi na nagka kaso while may current application sa abroad, so dapat po pala nasa RTC (Regional Trial Court) na ang case but if nasa mtc there's no way na i hold ka ng immigration to leave the country dahil wala k nmang hdo even u have pending case. Nakikita po ba sa imiigration ang record ng isang tao kung may pending case ito sa mtc. Thank you po sa inyong pagsagot
