Pinipilit magbayad ng bestfriend

I am an OFW wife po. Badly needed po advices. I have this friend for decades. Dati nung nagsimula palang kami mag asawa ang ng naitulong ng friend na to sa amin, at sya pa ang nag iinsist mangutang kami at pahiramin kami ng pera. Ang nangyari nagka away kami for some childish reasons dahil nagkaroon siya ng bagong bestfriend na pinakialaman ang accounts ko na nakita nya sa laptop nya. Bigla nalang itong bestfriend ko dati nagsingil at ngayon pinepressure ako magbayad ng 40k per month dahil dahil daw ang utang ko umabot ng 800k. Walang proof at walang pinirmhan bakit umabot ng 800k. Oo nagpahiram siya ng kusang loob at tinanggap ko naman ito. Ngayon ayaw nyang maniwala na hindi ko kayang bayaran at pinipilit nya akong mangutang sa iba para mabayaran ko sya dahil lubog na daw sya sa utang. Dumating pa sa time na pinahiya kami kahit since January 2018 nagbayad po kami ng 40k a month sa kanya.

Ang bahay at sasakyan namin sinacrifice namin di namin binyaran dahil inuna namin ang 40k demand nya. Talaga bang pwede nyang ipilit sa akin yun? Nakakastress na talaga lalo pat buntis ako at bakasyon ang husband husband wala pang line up sa barko pinababayad pa rin kami.

Kung talagang matagal na ang utang na ito at hindi nakasulat magiging defense ninyo na ang utang na ito ay nagprescribe after the lapse of 6 years kung in writing ito your friend can file action as long as hindi lalampas ng 10 years ( ayon sa Civil Code, Art. 1144 to 1145). Dapat kasi ang loan at ang interest ng utang ay nakasulat kung magkano kif not in writing maari po kayong maghain ng reklamo sa court para ipa fix yong interest. In your case, pwede maghain muna sa Barangay ng reklamo para atleast hindi naman magastos para sa inyo to determine kung magkano talaga ang utang at ang interest nito. Siya dapat ang may burden to prove kung magkano ang loan.
