Matagal ng hiwalay ang mommy at daddy ko since 1984, dahil may ibang babae si dad.Umabot sa korte kung sino dapat mangalaga sa min magkapatid at nanalo si dad dahil nawalan ng panahon ang mommy namin sa ipaglaban kami dahil ng abroad sya.Sa madaling salita si dad at ang kabit nya ang nagpalaki sa min, pareho silang gov't employee noon.Hindi maganda ang pakikisama namin mgkapatid sa piling ng kabit nya. Salbahe sya sa amin. Nagkaroon sila ng 3 anak, at halos kaming mg kapatid ang nag alaga sa kanila.Ngayon ay nasa tamang edad na kaming, may sarili nang pamilya. Nakatira po ako ngayon sa lupa at bahay na nabili ni dad noong 1987.Andito rin po ang mga anak nya sa ibang babae pati rin ung kabit nya.Lalong di kami mg kasundo dahil sa di pantay na hatiaan dito sa bahay. Ang isa ko namang kapatid ay inaalisan ng karapatan ng kabit ni dad na tumira dito.At palagi po pg nag aaway kami ng kabit, sinasabing wala ring karapatan ang mommy ko sa property ni dad, dahil annulled daw ang kasal nila. Pero napatunayan ko sa NSO sa andun pa rin ang record ng kasal nila at walang anumang nakanote ng annulment.May karapatan pa ba ang mommy namin sa mga property ni dad? at ano ang dapat na mapunta sa mga kapatid namin sa kabit nya? At yung kabit nya, ok lang ba na gamitin ang apelyido ni dad, hindi naman sila kasal?

Jeteth, isang tanong: Kanino naka-pangalan ang titulo ng bahay at lupa? Kay Dad mo ba? Nakalagay ba ay "married to (name of your mom)? Kung iyon ang nakalagay, the house and lot belongs to your mom and dad. Your mom and all of your siblings (pati ang mga anak ng Dad mo sa kabit niya) ay may bahagi doon, kasi, your dad's share belongs to all his children. Iyon na nga lang, ang illegitimate children have a smaller share than legitimate children.

The best thing is to ask a lawyer. Kasi, Sa totoo, if the lot is in the name of your mother and father, and your mother is still alive, your mother can shoo away all those who have no right to the land.

Since wala akong nabasa o nakitang document, I cannot answer you definitely. Mas mabuti kung kayo ay komunsulta sa inyong abogado. Good luck.

Sa batas, smaller share lang ang dapat sa mga illegitimate child, pero pwedeng mas subra pa dun kung gugustuhin ng dad namin?.at pwede rin ba na tangalan nya (dad) ng karapatan ang legitimate children nya?.Nakapangalan nga kay dad yung lupa.Malamng married po ang nakalagay doon, dahil ingat sya sa mga dokumento noon dahil gov't employee nga cya.

The way that you can see if your parents' marriage had been annulled is if you ask for a Certificate of No Marriage (CENOMARR). It is a search conducted by the NSO (now called the PSA) of the Index of Marriages to see if there is a marriage registered with your parents' name.

If your parents' marriage was annulled, the NSO/PSA will put there that the marriage was annulled subsequently and it will put in the date, the name and branch of the court that issued the annullment. Kung wala nito, the marriage was not annulled. It subsists.

Nakuha ko po ang NSO Marriage certificate ng dad at mom ko..Wala namang nakalagay ng kung ano man na nangyaring annullment..di pa ba sapat yun?, kelangan pa rin ng CENOMARR?..
