Ano ang proseso sa pgbili ng portion ng lupa?

Ako po ay bibili ng portion ng lupa sa aming kamag anak na my ari ng lupa na aming tinitirhan. Ang titulo po ay nasa name pa ng deceased owner at ito po ay conjugal property. Ang surviving heirs ay  yung spouse at 5 legitmate children. Wala pa pong EJS na naexecute. Safe po ba ang pgbili nito if spouse lang ang pipirma sa bilihan? Ipasurvey din po namin yung lot na bibilhin with their presence. Pwede po ba silng magbigay ng contract to sell or deed of sale na approved ng notary public kahit ito ay pang extra judicial settlement?THANK YOU
