Anong gagawin kapag ang bahay at lupa na kinuha sa Pagibig ay may nakatira na ayaw umalis?

Ano po bang gagawin ko attorney. Nakakuha po ako ng bahay at lupa sa Pag Ibig thru housing loan sa kanilang aquired asset. Mahigit 2 taon ko na po yun nahuhulugan Gusto ko na pong lipatan. Ang problema may nakatira ayaw umalis . Nalaman ko po na ang nakatira ay hindi po pala ang dating may ari. Sinasabi nya po sa akin na binili daw po yun ng anak nya sa dating may ari at yung anak nya namatay na daw .

Ano po ang gagawin ko samantalang lahat ng dokumento hawak ko po galing pag ibig?

You need a lawyer for this. Pero, without seeing any documents whatsoever, ang aking sapantaha na nangyari diyan, ang dating may-ari ay nag-loan sa Pag-ibig, hindi niya nabayaran kaya ito ay na-foreclose ng Pag-ibig. Tapos, dahil sa mahabang proseso ang foreclosure ng Pag-ibig, naibenta noong dating may-ari sa iba at sila ay pinatira doon. Maaring totoo na binili noong anak niya doon sa may-ari dati. Maari naman ding hindi.
Ang problema,ang lupang naka-real estate mortgage, hindi puedeng ibenta noong nangutang ang lupa ng walang pahintulot ang Pag-ibig, kasi nga mayroong utang iyon.
So, dahil sa ang nag-benta sa inyo ay Pag-ibig, na siyang mayroong superior lien sa lupa, mas superior ang title ninyo kaysa sa doon sa nakatira ngayon. Dahil sa wala naman silang maipakitang evidence of title, kayo pa rin ang may superior rights.
I think that you can file a case of ejectment. kasi, you no longer tolerate their possession of the property. You will need to send them a demand letter, giving them time to vacate. Pag natapos iyong palugit na inyong ibinigay sa inyong demand letter, kailangan ninyong mag file ng complaint sa Lupong Tagapamayapa sa Barangay. Dalawang hearing sa barangay ang mangyayari. Pag hindi kayo nagkasundo, humingi kayo ng Certification to File Action mula sa Lupong Tagapamayapa. Tapos, puede na kayong mag-file ng kasong Ejectment sa pinaka-malapit na Metropolitan o Municipal Trial court. You need a lawyer for this. Good luck.
