May 4 2017 pumirma kami ng notice of termination due to redundancy at memorandum of agreement kung kelan namin makukuba separation pay at final pay . June 2 2017 kukuha sana kami ng separation pay pero pagdating namin nagfile daw ng bankruptcy ang company at wala daw kaminh makukuhang separation pay ngayon kase nakafreeze daw ang asset ng company ( anong silbe nung pinirmahan namin ? Eh pinirmahan namin yun 1 month bago mag file ng bankruptcy .) pag nag file po ba kami ng case malake chance namin na manalo? May makukuha po ba lahat ng employees ang separation pay nila pag nanalo? PS - nasa pilipinas po kame at company

Ganito po iyon. Ang kumpanya po ay bankrupt. so, ang dapat po ay kayo ay magfile ng kaso sa NLRC. Dedesisyunan ito ng NLRC pero, ang execution ay hindi magaganap, sa halip, ipa-file ninyo ang Orders at Decisions ng NLRC doon sa Receiver ng kumpanya.
Ang mangyayari po, kung may mga ari-arian ang kumpanya ninyo (palagay ko naman dahil sa sila ay nag-file ng bankruptcy), ang mga utang nila sa mga empleyado ay mauunang bayaran. May preference po kasi ang mga empleyado para sa kanilang mga claims for unpaid wages and other benefits.
So, ang pinaka-mahusay po ay maghanap kayo ng abogado, ang PAO po ay humaharap na rin sa NLRC. Kailangan ninyong i-prosecute ang inyong claims sa NLRC at kailangang manalo kayo doon. Tapos, ang execution ay doon na sa Receiver. Kailangan din na ang inyong mga papeles (tulad ng complaint at position paper) ay inyong i copy-furnish ang receiver ng kumpanya para on notice sila na may mga claims pa kayo. Please hurry. Kung ang receiver ay matapos na sa kaniyang trabaho na i-distribute ang mga ari-arian ng kumpanya ninyo, baka wala na kayong mahabol pa.
