Need po namin ng advice.ganito kasi un, yung papa ko nakabili ng lupa sa isang squater area since 1989.pinatayoan nila ng bahay at tumira po kami ng isang taon dun,since nadistino yung papa ko sa ibang lungsod.pina rentahan muna nya ung bahay namin sa tito nya kasi naawa yung papa ko dahil walang bahay masilungan para sa mga anak nya. then since po dun pina renovate nila ang area. pero d napo cla nag babayad ng renta sa papa ko (1 year lang nabayaran nila). 2012 po umalis na po sila.,at naiwang walang tao ang bahay at lupa ng papa ko ngayon.then 2017 pinuntahan ng papa ko ung asawa ng tito(patay na yung tito nya) sa bahay nila sa probinsya,para sabihin na pwede na bang kunin na nila yung lupa. ngayon po ayaw na nilang ibigay sa amin ang lugar kasi nabili na daw nila yun at wala na daw kami karapatan kasi sila na ang nagpa renovate at nakatira dun for how many years.Tanong ko po may laban po ba kami kung sakaling ipapa demanda namin sila??at ilang taon po ba aabot yung kaso if mahain na namin?. Sa lugar din pala namin naging dalawa ang paksyon ng Association. NHA association(w/ Brgy Cert, BIR reg,Sec Reg 1989-2017) Adkosai association (w/o Brgy Cert,NOT BIR REG, NOT SEC REG) Eto po ang hawak nilang documento, -NHA Homeowners Association logbook(expired sa sec/declare as lost) year 1995-1998, -Temporary reciept ng adkosai association.(Yung nabibili lang sa mall,Pictured then printed sa coupon bond.) Eto naman yung hawak namin na documento -bill ng kuryente since 1989 -latest Homeowners Association logbook(sec reg) 1998-2017 -association reciept(Members fee/Monthly dues) year 2017 BIR Reg. -old map since 1989(sa mapa,nakapangalan yung epilyido ng papa ko) -sworn statement ng asawa ng unang nag accupy(patay na kasi yung mister nya) na tinransfer samen yung rights ng lupa nila nung 1989.(notaryado ng lawyer)dated Aug 2017. -Home owners membership cert.

You need a lawyer. Ang lupa po kasi ay malamang walang titulo. So, kumbaga, mga rights to occupy lamang ang meron diyan. Ngayon, wala din naman kayong mga registration. Ang pinang-hahawakan lamang ninyo ay ang mga membership ninyo sa mga homeowners' association.

Kasi po, sa batas, occupancy and possession gives rise to the presumption of ownership lalo na at wala namang kayong mga kasulatan, walang titulo, walang resibo sa mga ibinabayad na renta.

Kailangan kayong dumulog sa isang abogado at kailangan kayong maghabla para maprotektahan ang inyong mga karapatan.
