Kinasal sa Japan, at ang may dating asawa na pala siya. Ano dapat i-file para ma-nullify ang kasal?

Kinasal po ako sa pinoy na walang visa dito sa Japan last 2006. Di rin po sya na-visahan. And while waiting ng visa nya nagkaroon pa sya ng karelasyon dito.

Umuwi po ako ng pinas at doon nalaman ko na may kasal na pala sya at may 2 kids since 1996 pa. Ano po ba ang case na dapat i file para ma recognize na null and void ang kasal ko sa pilipino? Thanks po sa reply

You have to file a petition for declaration of nullity of your marriage to him. Hindi mo kasi sinabi a post mo kung saan kayo ikinasal sa Japan -- sa Philippine Embassy ba? O isa itong civil marriage sa ilalim ng mga batas ng Japan?

Nagulat naman ako na hindi kayo hiningian ng Certificate of No Marriage o kaya'y Certificate of Eligibility to Marry. Sigurado ka bang ang kasal mo sa Japan ay rehistrado?

Kasi, kung hindi naman rehistrado ang kasal mo sa taong iyan (lalo na dito sa Pilipinas, eh, di, dito sa Pilipinas, hindi ka kasal, diba?) Kasi, if your marriage in Japan was not registered in the Philippines, then it does not exist as far as the Philippines is concerned. Doon ka sa Japan magpapa-declare ng nullity or magpapa-divorce. kasi, doon valid at registered ang inyong kasal.

Post ka ulit, kulang kasi ang mga facts sa iyong post. Hindi ko tuloy masagot ng maayos.

Thanks po sa reply atty dto po kami kinasal sa Phil Embassy osaka Japan po. May naipakita po sya cenomar sa akin ang kausap nya po mag prepare ng docs ay ang nanay nya mismo po.
Kaya po ng try po aq na mag request ng marriage contract namin sa Nso meron po lumabas na record ng kasal namin, nag try dn po aq mag request ng cenomar nya lumabas po ang dalawang kasal nya una sa wife nya last 1996 and yun samin 2006. Magkano po kaya magagastos sa petition ? Salamat po ulit.
