Di binayaran ng separation fee, kahit regular employee ako? Hindi naman ako nagresign

Pagdi ka ba nagpirma ng suspension letter ng kompanya na pinareceived sayo pero nagpasuspendi ka pa rin tapos pagbalik mo ng opisina niyo pinasuspendi ka at terminate dahil sa di mo pagpirma ng pinarecived nila? May terminate letter na po ako ngayon tapos binabayaran na nila ako tapos sabay di sila nagbayad ng separation fee ko. Tama ba ginawa nila sa akin na di nila ako binayaran ng separation fee gayong regular ako at di naman ako nagresign tinanggal lang nila ako. Patulungan naman po ako kung ano dapat kung agwin..salamat po..pilipinas po ako ngwowork.

Una, sabi mo, may suspension letter na pinapa-receive. Bakit ka sinususpend?

Pangalawa, ang suspension ay puedeng preventive suspension -- ibig sabihin nito, may gagawing imbestigasyon kaya nais nila na wala ka muna sa opisina para hindi mo mapakialaman ang ibestigasyon. Kailangan ang preventive suspension ay hindi lalampas ng 30 days.

Pangatlo, ang suspension ay puede ding penalty. Halimbawa, nagkaroon nga ng imbestigasyon at nakita na mayroon kang pag-labag sa company rules and regulations, puedeng ang ipataw na kaparusahan ay suspension.

Kung ang suspension ay isang preventive suspension, at lumampas na ang 30 days, kailangan, kung ito'y ie-extend nila, babayaran ka nila ng suweldo kahit hindi ka pumapasok sa trabaho. Kung ito'y suspension bilang isang penalty, kailangan ay:

1. Mayroong just cause.
2. Mayroong first notice na kung saan naka-lagay ang iyong paglabag sa company rules.
3. Mayroong opportunity to explain.
4. Mayroong ibibigay na 72 hours para ikaw ay mag-explain in writing.
5. Mayroong second notice kung saan, ipinapa-alam sa iyo na ikaw ay pinaparusahan ng suspension at sinasabi kung hanggang kailang ang suspension (from July 1-15, 2017, kunwari).

Ngayon, kung ikaw ay ise-separate nila, kailangan din ay may just cause or authorized cause. kailangan din na sundin ang mga procesong nabanggit ko na. Kung hindi nasunod ang proseso o di kaya'y walang just or authorized cause, puede kang maghain ng reklamo sa NLRC for illegal dismissal or constructive dismissal.

Puede kang pumunta sa Public Attorney's Office (PAO). Sila ay may sangay na tumutulong sa mga manggagawang tinaggal sa trabaho at tumutulong sila na magfile ng kaso sa NLRC. Sana'y nasagot ko ang iyong tanong. Good luck sa iyo.
