Para lamang po maintindihan ninyo, ang legal separation po ay hindi pareho ng divorce or annulment. Sa legal separation po, may karapatan kayong hindi magsama, may karapatan kayong hindi paki-alaman sa inyong pananalapi, pero, KASAL pa din kayo sa ilalim ng batas.
Sa annulment po kasi, sasabihin ng husgado na ang kasal ninyo ay idine-deklarang walang bisa, kaya, hindi na kayo kasal pa sa isa't isa.
Sa divorce naman po (sa kasamaang palad, wala pang divorce sa Pilipinas), may bisa ang kasal ninyo, ngunit binibigyan kayo ng husgado ng pagkakataon na putulin ang ugnayan bilang mag-asawa.
Kailangan po kayong mag-file ng Petition for Legal Separation sa Family Court. Ito po ang Regional Trial Court sa inyong probinsiya o siyudad. Kailangan po ninyo ng abogado ninyo.
Kailangan po ninyo ng grounds (kadahilanang pinaninindigan) para sa Legal separation. Sampu lamang po ang mga grounds para sa Legal Separation:
1. Repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner;
2. Physical violence or moral pressure to compel the petitioner to change religious or political affiliation;
3. Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of the petitioner, to engage in prostitution, or connivance in such corruption or inducement;
4. Final judgment sentencing the respondent to imprisonment of more than six years, even if pardoned;
5. Drug addiction or habitual alcoholism of the respondent; chan robles virtual law library
6. Lesbianism or homosexuality of the respondent;
7. Contracting by the respondent of a subsequent bigamous marriage, whether in or outside the Philippines;
8. Sexual infidelity or perversion of the respondent;
9. Attempt on the life of petitioner by the respondent; or
10. Abandonment of petitioner by respondent without justifiable cause for more than one year.
