Need po ng advice regarding sa decision ko na ihinto ung pagbabayad ko ng loan sa banko dahil hindi ko na po kaya. The problem is yung developer po ng condo unit na acting as collateral ay maibibigay yung mga necessary documents para sa handover sa banko sa April 2018 pa. And dahilan po nila kakapasa lang daw po ng unit title sa land registry dept naten. Gusto ko pong malaman kung ano ang pwede kong gawin para sa ganitong sitwasyon. Maraming salamat po.

Hindi ko maintindihan ang kuwento mo. This is what I understand: Bumili ka ng condo unit on installment. Nag-apply ka ng loan from a bank para bayaran mo ang condo unit on installment. Ngayon, ang developer, dapat, nag-hand over ng title ng condo sa bangko, pero, na-delay kaya 2018 pa daw. Ganoon ba?

Kaya naman ikaw, gusto mo nang itigil ang pagbabayad sa bangko? Hindi mo naman nabanggit kung ilang taon ka na nagbabayad sa bangko. Mahalaga ito. Kasi, if you have been paying for the lot for two years already, hindi na ito puedeng ma-ilit. Instead, pababayaran na sa iyo ng buo iyon.

I think you have a few options: (regarding the condo)
1. You can continue to pay for the condo
2. You can sell the condo
3. You can rescind the contract to sell

Regarding the bank, mayroon ka kasing promissory note na pinirmahan at mayroon kayong real estate mortgage. Iyon na nga lang, kung hindi pa naman nai-ha-handover ng bangko ang title sa Bangko, hindi pa naipapa-annotate ng bangko iyong mortgage sa likod ng title.

Ang problema lang diyan, if you stop paying the bank, they may foreclose on the mortgage. If you sell the condo, baka hindi pumayag ang bangko. Nasa pangalan mo pa rin iyon kahit na naibenta mo na at iba na ang nagbabayad ng utang mo sa bangko.

I have not read any of your documents kaya hindi ko masabi kung ano ang dapat o pinaka maigi mong gawin. Ang nasabi ko lang dito, kung ano ang puede mong gawin sa ilalim ng batas.

Kailangan komunsulta ka sa abogado, dalhin mo lahat ng papeles mo. Hindi kita puedeng payuhan dito.
