Pag na-legalize annulment, pwede na ba ipabago ang apelyido ng anak namin?

Plan ko mag file ng annulment dahil babaero yung husband ko at di na sya umuuwe samin kahit ilang beses ko sya kinausap. Pag na legalize na annulment namin, pede ko na din ba ipabago surename ng anak namin? Gusto ko totally umalis sya sa buhay namin mag ina. Thanks and more power

Hindi ko po masabi ng tuwiran kung ang inyong mga anak ay puedeng palitan ang kanilang mga pangalan.

Una sa lahat, ang inyong mga anak ay bunga ng isang valid marriage. So, legitimate sila at bilang legitimate children, sila ay may karapatang taglayin apelyido ng kanilang ama.

Pangalawa, mukhang ang inyong annulment ay sasailalim sa Article 36. Ang mga batang bunga ng isang kasal na na-annul sa ilalim ng Article 36 (psychological incapacity) ay considered legitimate pa rin sa ilalim ng Family Code.

So, hindi po ninyo mabubura ang bahagi ng inyong asawa sa buhay ng inyong mga anak sa pamamagitan ng pag-palit ng kanilang pangalan. AT kung papalitan ninyo ang kanilang mga pangalan, kanino ninyo sila ipapangalan? sa inyo po ba? Kung ganoon, lalabas po silang illegitimate children.

On a personal note, ang karapatan po na taglayin ang pangalan ng ama ay karapatan ng bata -- kasi po, ang pagdadala ng apelyido ng ama ay isang paraan para ma-tanaw silang tagapag-mana ng kanilang ama kung ito'y yumao't mamatay na.

Kung halimbawa po'y na-annul nga po ang inyong kasal, puede po naman ninyong patanggalan ng parental rights ang inyong asawa dahil na rin sa kanyang kapabayaan. Pero, palitan na lamang po ninyo ang pangalan ng inyong mga anak by having them adopted by your new spouse if you will remarry.

Para po mas maliwanagan kayo, maiging komunsulta kayo sa inyong abogado.
