Sobrang laki ng interest, pwedeng kasuhan?

Ang husband ko po ay nagkautang ng pera sa halagang 100,000 sa kanyang Auntie.

Salary Loan po iyon kaya ang ATM ay nasa kanya. Siya na po ang nag wiwithdraw ng kanyang salary full every 15 and 30 payroll ng husband ko. Natapos na po namin bayaran ang capital plus 10% interest in 1 year dahil iyon po ang kasunduan nila. Nang kukunin na po namin ang ATM sabi po niya kulang pa po yong bayad namin dahil sabi nya 10% daw po ang interest sa 100k every month bakit po ganon ang laki naman nang interest e'hindi nman yon ang kasunduan nila ang pagkakaalam lang po ng husband ko e 10% lang po within 1 year. Ano po gagawin namin need lang po ng advise dapat ba kaming matakot when she file a case against my husband? Palagi po nya kaming pinagsabihan na magbabayad pa kami sa remaining interest o gusto niyo nang gulo. Advice naman po. Salamat!

Isara na lamang ninyo ang inyong account. Magpalit kayo ng payroll ATM ninyo sa banko. O kaya, ireport ninyo na lost ang ATM para ma-invalidate na ang ATM ninyo.
Hindi ko nakita ang kasunduan, kaya hindi ko masabi kung ang inyong kasunduan ay usurious. At kahit na pumayag kayo, may batas po laban sa pag-kuha ng buong suweldo ng tao upang bayaran ang utang -- kasi, ano naman ang kakainin ng tao kung ang buong suweldo ay pambayad lamang sa utang? So, doon pa lamang, medyo, onerous na ang contract.
Talk to a lawyer, sa PAO at sa IBP mayroon silang mga abogadong puedeng magbigay ng payo.
