Ndi legally separated at balak bumili ang wife ng properties. Kelangan ba ang pirma ng husband sa pagpatitulo khit na pera ng wife ang pambili? If sakaling magpagawa ang wife ng last will na hindi nkasali ang name ng husband, magkakaroon pa rin ba sya ng karapatan sa mga properties khit wla syang naiambag sa pag-acquire ng mga ito? 17yrs nang wlang communication sa isa't-isa. Pls advice. Salamat po.

First of all, kailang sila kinasal? Before 1989? Or after 1989? Kasi, kung after 1989, sila ay sumasailalim ng Family code at sa Family Code, ang default ay absolute community of property regime.

Sa absolute community, lahat ng ari-arian ng mag-asawa noong sila'y binata't dalaga pa, lahat nito'y magiging bahagi ng kanilang marriage properties. Ngayon, kung sila'y hiwalay na pero hindi sila legally separated or hindi sila annulled, sila pa din ay kasal.

So, kung halimbawa ay bibili ng lupa ang babae, kung ilalagay niya na siya ay "married" sa mga papeles niya, chances are, ang titulo ng lupa ay nasa pangalan ng babae tapos nakalagay na "married to" -- kapag nakalagay ang "married to" there is a presumption that this is part of the properties of the marriage. Kaya kung may utang ang asawa niya at habulin ng mga pinag-kaka-utangan ng lalak ang mga properties noong babae, kailangan pang i-prove noong babae na hiwlay na sila, na ang lupa ay nabili niya using only her money dahil sa walang inambag ang lalaki.

Ganoon din, kung siya'y mamatay, heir o tagapag-mana pa rin ang dating asawa kahit sila'y hiwalay na kasi, hindi naman naipa-annul ang kanilang kasal. Komunsulta sa abogado.
