Ganito kasi iyon, ang laws on marriage ng Pilipinas applies only to Filipinos. Also, our criminal laws can only apply to persons within the Philippines. So, if the American is married to another American and the marriage is under American law, and the spouse of the American is not in the Philippines, malamang sa our laws on marriage and criminal laws will not apply to the American.
Tanong ko lang --sino ba ang magde-demanda? Yung American spouse? Kasi, iyon lamang American spouse ang may karapatang mag-demanda ng concubinage laban sa asawa niyang may kabit. No one else can file this case.
If the American spouse travels to the Philippines and comes to court and files a case for concubinage, the spouse can always prove that the laws of the state where she was married also penalizes concubinage, puede niyang ide-manda at maipakulong ang kanyang asawang Amerikano dito sa Pilipinas.
