13 years na walang communication, dalawang kasal sa NSO, pwede i-annul?

13 years na po sila wala communications mag asawa. Kasal po sila sa civil ng 13 years na taong 2002 lately na trace sa NSO na ikinasl sya ulit sa civil taong 2006 na nasa NSO din un file. May possible ba na mawala bisa na una kasal noong 2002/at may possible ba maibalik un surname nya sa single?

Well, the law says that it is the subsequent marriage that is void. Iyong first marriage and valid. Kasi, the first marriage is the one that is respected. Nga naman, diba, if you know that you have been married before, and you get married again, then you knew you could no longer get married and yet, you still got married -- there's an element of fraud in that.

So, in response to your question, kung puedeng ang unang marriage ang ipa-declare na void, the answer is no, it cannot be declared void dahil lang sa nagkaroon ng subsequent marriage noong 2006.

This does not mean, though, that the 2002 marriage cannot be annulled, pero, ibang usapang na ito.

atty bimbi, yan po ang case ng bf ko ngayon dalawang beses kinasal sa unang asawa at may pangalawa asawa po dw ang bf ko ngayon po ung una eh hiwalay na po sila may kanya kanya na din silang pamilya. eto po yong pangalawa kinasal dw sila nong 2005 sa iloilo at may anak sila isa after po nun 2008 umalis po ung bf ko pumunta d2 sa dubai at d2 naman kami nagkita at nagsama. nalaman ko po kc nag send ng copy of Marriage contract ang babae na kasal dw po sila at ang nsa contrata po same name ng bf ko same address kaso po yong middle name lang po ang naiba. ndi naman po siya pwde ikasal db po atty kc kasal po siya sa una. kinasuhan po siya nong babae sa pag abunduna sa kanila dw mag ina.naguguluhan po ako atty. ano po ba advice nio po.
