Do I need to pay 100 thousand pesos to clear status in NSO? I want to remarry

Muslim married po ako dito sa Dubai. Egyptian po nationality nya at may isang anak po kami, pinagawan ko po ng pilipino passport ung anak ko kaya po na ireport sa NSO na kasal ako. Ngayo po divorced na kami since 2011.


Ang aking katanungan po ay, Ano po bang dapat gawin kung gusto ko po ulit magpa kasal sa iba? Totoo po bang 100k daw ang magagastos para po ma clear or dissolved ung status ko sa NSO/ CENOMAR? Kung magpa kasal po ba ako without clearing my status, magkaka problema po ba ako? may divorced paper po ako at naka DFA stamp na po sa Dubai Court, Philippine Consulate at DFA po sa pilipinas at naka translate na din po sa english sa legal translator.


Sana po matulungan nyo ako sa aking sitwasyon maraming-maraming salamat po.



Topic: I was married in Muslim wedding in Dubai. My husband is an Egyptian national and we have a child. I had done a Filipino passport for my child and reported to NSO that I am married. Now we are divorced since 2011.

What should I do if I want to remarry again? Is it true that I need to spend 100 thousand pesos in order to clear or dissolve my status in NSO Cenomar? If I marry without clearing my status, would there be a problem? I have divorce papers stamped by DFA in the Dubai Court, Philippine Consulate (Department of Foreign Affairs), and it is translated in English by a legal translator.

Hindi ko alam kung saan mo nakuha ang impormasyong kakailanganin mong gumastos ng 100k. Kasi, kung ikaw ay Muslim (Muslim ka din ba?), at ikaw ay ikinasal sa ilalim ng batas ng Shari'a, ang batas ng Shari'a ay tinatanaw din naman dito sa Pilipinas. Kung kaya't kung ikaw ay diborsiyada sa ilalim ng Shari'a sa Dubai, ikaw rin ay tatanawin na diborsiyada sa ilalim ng Shari'a sa Pilipinas.

Kung ang lahat ng mga papeles mo sa diborsiyo ay authenticated na at translated na -- baka ikaw mismo ay maaari nang maglakad ng recognition ng iyong divorce. Baka hindi mo na nga kailanganin ang abogado. Ba't hindi mo subukan?

Kung ikaw ay may mga kamag-anak dito sa Pinas na puedeng tumulong sa iyo, bakit hindi muna nila subukang mag-inquire mula sa NSO. Tapos, kung sabihin sa kanila sa NSO na kakailanganin ng abogado (malamang sa hindi kasi, pagpapatala lang naman iyon at saka ka kukuha ng Certificate of No Marriage or Certificate of Eligibility to Marry. Malamang sa matatagalan ka lang.)

Baka naman mamadaliin ng kung sino man iyong naka-usap ninyo kung kaya ganoon ang sinabi na fee. Pero, sa totoo, walang mga ganoon sa NSO. Magtanong muna kayo sa NSO mismo -- huwag sa mga fixer. Baka kayo pa ay masabit.

Maraming salamat po sa mabilis na reply. Hindi po aq muslim ung ex husband ko lang po kinasal lang po kami sa muslim. Pinapunta ko na po ung kamag anak ko sa NSO para po ipa recognize ung divorced ko at ang sabi po sa kanila na dapat pumunta sa Regional Trial Court (rtc) para po sa attestation then nung nag punta po ung kapatid ko sa RTC ang sabi po sa kanya na may hearing pa daw at mag hire ng abogado. Ano po ba ang dapat ko gawin ngaun kinasal naman po kami muslim way at divorced na din kami under dubai court (sharia). Sana mo matulungan nyo ako. Maraming salamat po.

Iyong sa RTC kasi, kailangan mong i-prove ang mga facts. Una, ang iyong citizenship at nationality na Pilipino, ang iyong fitness para ma-kasal, ang iyong kasal, ang iyong diborsiyo. Sa husgado mo kasi ipi-presenta ang mga documents mo. Husgado ang magsasabi kung ang mga ito ay authentic nga. Tetestigo ka doon. Minsan nga, sa commissioner (sa clerk of court) lang ang hearing nito matapos mong ma-i-prove ang jurisdictional facts.
Why don't you try na magpunta sa PAO -- tignan mo kung papasa ka sa requirements nila para sa indigency para entitled ka sa free legal assistance. Kung hindi naman, maaari kang pumunta sa Office of Legal Aid ng kahit na anong university dito sa Pilipinas na mayroong College of Law. Free legal assistance din ang binibigay nila doon.
Wala ka bang kakilalang Muslim na abogado? Mas matutulungan ka ng Muslim kasi, handa nilang i-explain sa mga husgado ang mga rules ng marriage at divorce sa ilalim ng Sharia. So, mas makabubuti sa iyo kung Muslim ang makuha mong abogado.
