Binenta ng magulang, property sold by parents, written document

Noong buhay pa ang aking inay binenta niya ang isang parte ng lupa sa akin at kami ay may kasulatan na pinirmahan namin ng aking mga magulang. May bisa ba ito kahit patay na ang aking mga magulang?


Question: When my mother was still alive, she sold a part of our land to me. We have a written document/contract which was signed by my parents and me. Is this still valid, even if my parents are already deceased?

Depende. Ang kasunduan ba ng pag-bebenta ay gaano katagal bago mamatay ang iyong mga magulang? Kasi, kung ito ay malapit sa petsa ng kanilang kamatayan, ito ay tatanawing isang paraan ng pagbibigay ng mana.

Ngayon, kung malayo naman sa petsa ng kanilang kamatayan, ang tanong ay, ang ibinayad ba sa lupa ay sapat? Kasi, kung minimal lang ang presyo ng bentahan, ito naman ay maaaring tanawin bilang isang donation.

Maraming puedeng interpretasyon. Depende na nga ang lahat sa mga facts. Hindi mo naman puedeng ilagay ang lahat dito. At hindi naman ako puedeng magbigay ng opinion na payak sa iyo, mas makabubuting ikaw ay pumunta at komunsulta sa isang abogado at nang magkaroon ka ng peace of mind.
