Fake age, marriage license application, invalid, consent, annulment

Ikinasal po ako ng Sept 1991. Ang edad ko po 16 at ang napangasawa ko mag 17 pa lang, pero sa marriage contract po namin pareho kami 18 yrs old! Tanong ko po kung valid po ba ang kasal namin kahit pineke ang edad namin?


Balak ko po kasi mag pa annull dahil matagal na rin po kaming hiwalay at may sarili na syang pamilya at may anak sa ibat ibang babae. At kahit minsan hindi po ako nakatanggap na kahit anong sustento na galing sa kanya.


Translation: I was married in September 1991. I was 16 years old then, and my husband was 17 years old. But on our marriage contract/certificate, it shows that we are both 18 years old. Is our marriage still valid, even if our ages were faked?

I plan to have our marriage annulled, since we've been separated for many years now, and he has another family now and children with other different women. I've never even received any financial support from him.

Only persons who are of majority age can get married. If you got married when you were not even 18, then your marriage is VOID ab initio -- it was never a marriage in the eyes of the law. You can file a petition for declaration of nullity. YOu will have to prove that you were 16 at the time that you were married.

Nagsama ba kayo after kayong nagpa-kasal? kasi, kung nagsama kayo, well, it depend siguro kung ilang taon kayo nagsama. Kasi, if you lived together as husband and wife for five years after you reached majority age, well, ibig sabihin ay tinanggap na ninyo ang kasal kahit na ito ay inyong ginawa noong mga menor de edad pa kayo.
