Pwede ba mag-file ng divorce sa Hong Kong, para mapawalang bisa ang kasal namin?

Magbabakasakali lang din po ako baka sakaling mabigyan niyo ng konting panahon at mapaliwanagan niyo na rin ako... Kasal po kami sa civil, mayors office po. Hiwalay na kami ng 5 years. Sa ngayon may kinakasama na po ex wife ko at nasa Hong Kong.

Ngayon po magpapakasal na sila ng bf niya na andun din sa HK. At sabi dun na lang niya ako idi-divorce. Pipirmahan ko naman un divorce letter na galing sa Hongkong ibig sabihin pumapayag ako.

Tanong ko po: Matatawag po ba na legal yun pagddivorce niya sa aken sa ibang bansa sa HK? Kahit na pumapayag ako? Maari ba magkaroon ng penalty yun ex-wife ko or maari kaya siya makasuhan o anuman?

Here it is: kung kayo ng asawa mo ay parehong Filipino citizens, ang kasal ninyo sa Pilipinas ay hindi puedeng i-dissolve ng isang divorce sa Hong Kong. Kasi, ang batas ng kasalan ay umiiral sa mga Pilipino kahit na nasaan sila sa mundo. So, since walang divorce sa Pilipinas, hindi ire-recognize ang foreign divorce ng isang Pilipino na kasal sa isa pang Pilipino kung ito ay ipapa-rehistro dito sa Pilipinas. Bale, hindi uubra ang foreign divorce para mapa-walang bisa ang kasal ninyo dito sa Pilipinas.

Having said this, alam mo ba kung ang iyong asawa ay naging citizen na ng Hong Kong? Kasi, kung naging citizen na siya ng Hong Kong o ng kung anumang iba pang bansa, malaya na siyang makapag-pa-divorce.

Medyo mahirap naman akong maniwala na nakapag-pa-kasal ang asawa mo sa Hong Kong. Kasi, ang Hong Kong, hihingi at hihingi iyon ng Certificate of No Marriage mula sa asawa mo para mag-issue ng marriage license. kasi nga, kung hindi citizen ng Hong Kong ang asawa mo, maingat ang Hong Kong na magkasal ng mga foreigners.

I think na baka hindi registered ang kasal ninyo sa Philippine Statistics Authority. Baka kasi hindi naipa-rehistro ang inyong civil wedding sa Mayor's Office. Hindi mo naman nabanggit kung kailan kayo naikasal. Kasi, simula noong 1989, noong umiral na ang Family Code, hindi na bingyan ng kapangyarihan ag Mayors na mag-officiate ng marriage. So, ibig sabihin, walang karapatan ang Mayor na magkasal ng mga tao simula pa noong 1989.

Malamang nga na ang inyong kasal ay hindi rehistrado sa Civil REgistry dahil sa walang karapatan ang mga Mayor na mag-officiate ng marriage. Please check if your marriage is registered with the Philippine Statistics Authority (ito na ang bagong pangalan ng NSO ngayon).

Malamang sa kung hindi rehistrado ang inyong kasal, naka-kuha ng Certificate of No Marriage ang iyong asawa at ito ang dahilan kung bakit siya'y nakapag-pa-kasal sa isang foreigner or non-Filipino citizen sa Hong Kong. Malamang sa hindi ka talagang na-divorce kundi, wala kayong valid marriage to speak of.

kasi, maingat naman ang Hong Kong, alam naman nila na ang mga Pilipino, hindi puedeng mag-divorce, so, a marriage celebrated in the Philippines cannot be dissolved by a divorce in Hong Kong.

Well, I cannot really answer you fully kasi, kulang ang mga facts na iyong ibinigay sa akin. Wala naman akong nakitang documents. Ang pinaka mabuti, ikaw ay kumuha ng abogado at inyong imbestigahan kung ano talaga ang nangyari. i suggest that you also go to the PSA and try to get a copy of your marriage certificate.

opo preho kaming fil citizens.. tingin ko hindi pa citizen ng Hongkong yun asawa.kase wala nman po hiningi sken na Certifcate of no. Marriage. Pinaldahan po niya ako ng Divirce letter mula Hk petitions letter ata dko po kc alam..at pumirma po ako sa petition ng asawa ko.since auko na rin sa kanya:) Atty. bakit po gnun nakakuha nman ako kami ng mga documents mula sa NSO pa noon ng Marriage Certfcate dahil nga po eto ay Requirments noon pra sa Work Abroad. Meron din ako kopya ng NSO original din po.. kinasal po kami noon 2006 Mayors office. eto po ba yun tntwag na civil wedding? so ibg sabhin parin atty. hindi pa rin valid yun kasal namin? kahit n may NSO crtifcate??

ikakasal pa lamang po sila ng foreig bf niya atty. pagntpos na etong divorce letter.pblik na un letter sa hk nagun buwan ng september.

di po kaya fake din yun atty na gumawa ng letter sa HK? dahil po wala naman hiningi ng Certifcate of No Marriage.

may kopya ako ng letter mula hk Atty Bimbi n may red logo gling mismo sa HK at address nun office..pinicturan ko un front page at iba pa.

Atty Bimbi sana maliwanagan niyo ako mbuti dahil sa nalito ako rgarding abt sa wlang bisa magpkasal ang Mayors Office from 1989..kasal kmi noon 2006..

Sigurado ka bang hindi siya nagpa-annul ng inyong kaso?
Kung may NSO copy kayo ng inyong marriage certificate, then, your marriage was registered. So, on its face, it is valid.

Hindi ko masasagot kung paano siyang makaka-kuha ng divorce. I do not know how. I do not know how he went about doing it. Kaso, ikaw na rin ang nag-sabi na ito'y petition pa lamang, so, hindi natin masasabi if the Hong Kong court will allow him to divorce you seeing that Hong Kong should know that divorce is not allowed in the Philippines.

As for his marriage, ano ba ang gusto mong mangyari? Ayaw mo na ma-divorce kayo ng husband mo? Ayaw mong mai-kasal siya sa iba? You can always appear at their wedding and protest that he is still married to you under Philippine law.

I cannot really advice you in specifics kasi, I did not see any of your documents. I cannot advice you except to say that you can contact a lawyer in Hong Kong if you wish so that you can intervene in the divorce proceedings (if for example, you have a child with your spouse and you want support for your child, or if you have common properties with your spouse that you want divided between you). I don't know what happened.
