Kasal mula sa presumtive death at child custody ng naging anak

Atty Bimbi. Una po maraming salamat sa tulong ninyo sa aming mga Ofw.Tanung ko po sana kung paano ang magiging custody ng aming anak?Mula sa aking pinakasalan na babae sa pilipinas na may legal palang kasal na nailihim nya ng matagal. Nalaman ko lang po thru Nso lately na nag-file pala sya ng presumtive death ng ex-husband sa korte nya kaya kami nakasal sa huwes.At buhay pa ang ex-husband na matagal na nya hiniwalayan. Ano po ba ang unang hakbang na maaring kong gawin upang hindi madamay ang aming anak sa gulo na idudulot nya. Sakaling magreklamo nako sa batas para ipawalang bisa at ang maling paraan ng aming naging kasal.Maraming salamat po ulit at maligayang Pasko.

Are you in the Philippines? In order for you to get legal custody of your child, you must obtain physical custody of your child first. Kasi, mahihirapan kang bawiin ang iyong anak kung ito ay itago ng iyong asawa. So, dapat, nasa iyo muna ang bata, saka ka mag-file for legal custody ng iyong anak at putulin ang parental authority ng iyong asawa sa inyong anak.

Una, ang iyong asawa ay gumawa ng falsification. Buhay pa ang asawa niya, ipina-declare na niya itong presumptively dead. Ang inyong kasal ay walang bisa dahil sa hindi naman pala talaga patay ang una niyang asawa, kaya wala siyang karapatang mag-apply for a new marriage license. Lahat ng papeles na kanyang isinumite sa husgado, lahat ng kanyang pinanumpaan at pina-notaryohan na mga papeles -- lahat ito ay counts of falsification of public documents. So, ang taong ganito ay walang karapatang mangalaga ng isang anak.

You can have your marriage to her annulled. You can also file a complaint for falsification against her. Pero, yung asawa niya sa una ang may karapatang mag-file ng kaso for falsification doon sa presumptive death na ginawa noong asawa mo.
