Pangalawang asawa nakapangalan ang titulo, may habol ba ang unang asawa sa lupa?

Meron po akong friend na may kinakasama for 18 years. May 4 na anak sa unang asawa. Nagkahiwalay sila dahil nanlalaki ung babae. Nahuli nya kya hiniwalayan.

Ngayun na magkasama sila ng friend ko nagkaanak sila ng 3. Bumili sila ng haus and lot na nakapangalan sa kaibigan ko. Ang problema ginamit nya ang last name ng partner nya kya un ang nasa title ng lupa. Ang nakalagay sa titulo ay name nya with the last name ng lalake tapos married to-----(name ng partner nya). Gamit din ng mga bata ang last name ng tatay nila.

Ang mga anak sa una at anak nila ay magkakakilala at lumabas from time to time. Alam ng unang asawa ang tungkol sa partner at mga bata.

Ang tanong, may habol po ba una asawa sa lupa? Kung meron, ano kailangan gawin para wala silang habol? Yung panganay nyang anak 17 years old pa lang. Pwede ba sa kanya ilipat ung titulo ng lupa? Kawawa naman kasi sya. May trabaho sya simula nung nagsama sila nung lalake. Hati sila sa pagbabayad ng property,.

Your friend just committed an act of falsification of document. In the first place, she is not married, they are just living in. Okay lang na ang mga anak nila ay dalhin ang pangalang ng ama nila -- karapatan nila iyon.

Pero iyong friend mo, she has no right to carry her live-in partner's last name kasi, they are not married. And to claim that she is married is an act that will give the first wife the grounds to file a criminal complaint for concubinage against her husband at pati ang friend mo ay dawit dito.

Patungkol sa lupa, hangga't hini annulled ang unang kasal ng kinakasama ng friend mo, lahat ng ari-arian ng husband niya, may parte siya. Iyon na nga lang, kung halimbawa, ang ginamit na pera upang mabili ang property ay hindi mula sa pondo ng kanilang marriage, kundi sa pondo noong pagsasama niya sa pangalawa, the property can be saved for your friend.
