After filing the petition, and the respondent has already been served with summons, ibig sabihin ay nabigyan na siya ng kopya ng Petition mo noong sheriff or bailiff ng husgado, you can proceed to the next step.
The next step is, both the petitioner (ang nagdemanda) and the respondent (ang idinemanda) have to appear before the Prosecutor's Office for the prosecutor to determine that no collusion between the parties exist (na hindi kayo nagkasundo na kunwari lamang na gumawa ng mga dahilan para ipa-annul ang inyong kasal kahit na wala naman talagang mga dahilang legal para ito ay i-annul).
Kapag na-serve na ang summons, magkakaroon din ng service ng Order sa respondent for him to appear before the Prosecutor. So, kapag hindi siya nag-appear, gagawa ng certification ang Prosecutor na a katunayang ipinatawag niya ang respondent at natanggap niya ang Order, ngunit hindi siya sumipot.
Kung nag-appear na noong una ang respondent sa dalawang unang stages sa itaas at habang nagpi-Pre-Trial na ay hindi siya sumipot, ite-terminate and pre-trial at uumpisahan na ang presentation of evidence.
Kung halimbawa nag-appear ang respondent sa tatlong unang stages sa itaas at habang nagpi-presenta na ng ebiensiya ang Petitioner, hindi sumisipot ang respondent, patuloy ang presentation ng ebidensiya ng Petitioner, ngunit hindi na magkakaroon pa ng pagkakataon ang respondent na mag-cross-examination ang respondent.
Pag hindi na sumipot ang respondent kahit tapos na ang presentation of evidence ng petitioner, mawawalan na ng pagkakataon ang respondent na magpresent ng sarili niyang ebidensiya.
Ang hindi pagsipot ng respondent ay hindi paraan para siya ay i-declare na "in default". Magpapatuloy lang ang pagdinig ng petisyon.
