Direct hire, pwedeng lumipat sa ibang trabaho? Paano?

Direct hired ako. Kung gustu ko lumipat sa ibang trabaho, pwede kaya yun?

Wala namang makaka-pigil sa iyo na lumipat ng trabaho kung nais mo. Iyon nga lang, kung direct hire ka, hindi ako sigurado kung ikaw ay may working visa. Dahil sa kung aalis ka sa pinagta-trabahuhan mo na nag-direct hire sa iyo, at wala kang working visa, ikaw ay in-breach of immigration laws at ikaw ay liable na ma-deport. So, kung ang dati mong amo ay bengatibo, kadali nilang maghabla laban sa iyo.

Puede din naman na sa ilalim ng bago mong employer (kung ikaw ay may working visa na), ikaw ay sponsored nila. This will protect you. Kasi, iyong pag-daan sa POEA ay isang paraan para ma-proteksiyunan ang mga OFW. Kung wala kang registered na certificate of employment, dahil nga sa direct hire ka noong una at direct hire ka ulit dito sa pangalawa mong trabaho, puede namang ipa-rehistro ang iyong certificate of employment sa bago mong employer.

So, in other words, hindi ko masasagot ng detalyado ang iyong tanong kasi, kulang ako sa mga facts patungkol sa indibiduwal mong kaso at kalalagayan. Marami akong hindi alam. Isa dito, ay kung anong bansa ka nagta-trabaho sa ngayon. kasi, kung sa Australia, US, Canada, UK at iba pang European countries ka, okay lang sa kanila ang direct hire dahil sa mayroong adequate proteksiyon ng labor laws nila para sa mga OFWs. Pero, kung ikaw ay nagta-trabaho sa mga Arab countries, usually, to protect Filipinos, direct hires are really banned kasi, luha lang ang aabutin mo. Unfair para sa mga migrant workers ang kalimitang employment laws ng Arab countries lalo kung hindi ka Muslim -- you are an infidel and therefore, it doesn't matter if your rights are exploited. Except, of course, if you work for an American or European corporation with operations in Arab nations. Iba iyon.

Isa pa, kung ikaw ay direct hire, hindi ko alam kung ikay ay may employment contract. kasi, kung meron, dapat ay tapusin mo ang iyong contract term bago ka lumipat sa ibang employer or else, you are in breach of your contractual obligations and therefore, you cannot really expect to be protected in your right to stay in a country if you are at fault.

So, I really cannot give you an opinion -- there are far too many variables to consider kung OK lang ba na direct hire ka at lilipat ka ng employment.
