May karapatan ba na ipababaan ang utang sa bounced cheque, na lumaki dahil sa penalty?

Regarding sa personal loan sa isang finance lending agency way back 2012 pa po, I knew that bouncing checks can be a used as criminal case but unfortunately po nagbayad ako after mabounce yun checks na naissue ko tru their messenger.


But just last 2 months they send an demand letter na nakademanda daw po ako for issuing 4 bounce checks. The question is bakit po ngayon lang kung talgang hindi ako nakabayad. I was in the same address at madali para sa kanila hanapin ako and I gave my contact number wala na rin po kasi ako mapakita receipts (sa tagal ng panahon wala na yun mga hawak ko ng receipts). Dahil sa pagkakaalam ko wala nako dapat ipangamba dahil bayad na ako.


Ngayon po ang sinasbi nila nasa 29k pa po ang babayaran ko ang amount po ng bawat check ay nsa 1400 plus lang (di ko na maalala exact amount). Kundi ko daw bayaran makukulong ako?


Hindi naman ako nagtatago at kung sakali babayaran ko wag lang sana ganun kalaki kung compute. Nasa 5600 lang ang total pero ang sinisingil ngayon ay 29k kasama penalty. Dapat po ba talaga ganun? May karapatan po ba ako ng mag demand na babaan nila o alisin ang penalty charges? Please help me po. Im so stress that amount is big deal with me lalo na may mg aanak ako. Pls help po thank you

First of all, para mai-reconstruct ninyo ang mga ibinayad ninyo, kahit na wala na ang mga resibo sa inyo, iyong mga tseke na in-encash nila (iyong hindi tumalbog) iyon ang proof ninyo. Pumunta kayo sa inyong banko at humingi kayo ng statement. Doon makikita kung magkano na ang kabuuang nabayaran na ninyo.

Ngayon, kung kayo'y nagbayad na doon sa mga bounced checks, dapat ay may resibo kayo doon sa binayaran ninyo. Dapat din ay kinuha ninyo iyong mga tseke na binayaran na ninyo.

Kung wala kayong maipakitang mga resibo, harapin ninyo ang kaso, magpa-arraign kayo, tapos, i-settle ninyo ang cash value noong mga checks. Pero, hanggang doon lamang. Kasi, since criminal case naman ang kanilang ifi-nile, you are only supposed to pay the face value of the checks. Since the checks have a face value lower than that amount that they are demanding from you, sorry sila, criminal case ang kanilang sinampa, eh.

Kailangan lang ay matapang ka. Tapos, kumuha ka ng abogado na matapang-tapang din. Tapos, igiit ninyo na kayo'y hindi naka-tanggap ng notice or demand sa kanila na bayaran ang mga checks.

Suriin din ninyo kasi, kung ang mga checks ay dineposito beyond 90 days from the date of issuance, eh, hindi na kayo obligadong bayaran pa ang mga checks. kasi, dapat ay they encashed it within 90 days from the date on the check. Kunwari, December 31, 2012 ang date ng check, tapos, they deposited it into the bank on December 31, 2013, naku, sobra na sa 90 days so you are not obliged to keep funds for that check and the bank will surely dishonor a check that has been deposited beyond 90 days.
