Paano kapag wala sa NSO ang kasal, pero merong CENOMAR? Valid pa rin ba?

Paano ang gagawin kung ikinasal po ang isang babae sa hindi nya tunay na pangalan at wala po sa NSO, pero may SENOMAR po sila? Valid po ba ung kasal nila? Pwede pobang ma-void ang kasal? Thanks po

I think you misunderstand this.

1. Kung ang babae ay nagpakasal, pero sa marriage license at sa marriage contract ay ibang pangalan ang nakalagay (kunwari, ang tunay na pangalan ng babae ay Eva N. Adan pero ang nailagay sa marriage license at marriage contract ay Eva B. Adan, ang ikinasal ay iyong si Eva B. Adan, hindi si Eva N. Adan.

2. Kung ang naka-rehistro sa NSO (ngayon ay PSA na ang tawag dito sa tanggapan ng gobyernong ito) ay ang kasal ni Eva N. Adan, kung kukuha ng CenoMar si Eva B. Adan, talagang walang lalabas na kasal.

So, hindi na kailangang magpa-void ng marriage si Eva B. Adan -- kasi, wala namang nakatala sa NSO/PSA na kasal siya. Eva B. Adan is still considered unmarried under the law. So, if Eva B. Adan is considered unmarried under the law, she can still marry.

pag ang tao po ba kasal sa una at tama yong gamit niya na name surname at middle name.and nakita sa NSO at cenomar niya na kasal siya dun sa babae (halimbawa po John M Lago )valid po yun diba?
eh pano po may babae nagsasabi na kasal dw sila din sa lalaki at may NSO copy po din siya pero pagkakaiba po same name at surname yong middle name po ay iba ( Halimbawa John C Lago ) at wala po sa cenomar nong lalaki na kasal siya sa babae pangalawa at sa NSO birth niya ay tama po yong sa una.
ano po ba dapat gawin at advise magiging invalid po ba yong sa pangalawa at ang una lang po ba ang magiging valid na kasal?

Magulo ang iyong tanong. Pero, ito, it is possible for people to have the same first name and the same last name but a different middle name. The best thing is to ask also for copies of the marriage certificate noong dalawang tao na pareho ang pangalan na lumabas sa CENOMAR.

Kasi, when you compare the two marriage certificates, you will see kung the same ang name of parents, kung the same ang place of birth, kung the same and date of birth, etc. Kapag lahat ay magkaka-iba, that means, these are two very different people. So, kahit na lumabas sa CENOMAR ang hit noong unang kasal, kung hindi naman pareho ang name noong lalaki sa dalawang marriage certificate, then, you can argue that these are two different people.

The best thing is to consult a lawyer. Hindi ko nakita ang mga documents so I cannot really give you specific advice. Get a lawyer.

As for the question kung valid ba iyong second marriage, it depends. If it's the same person, then the second marriage is void, iyong nga lang, there has to be a declaration of nullity. Again, para matahimik ang isipan mo, go to a lawyer. Get all the pertinent documents, go to a lawyer, kahit sa IBP or sa PAO and ask for their opinion. I cannot give you a specific opinion as I have not seen any of the documents.

Tatanong ko lang po, kung ang Marriage license po ba ay makikita sa Marriage contract? And possible po ba na makasuhan ng Bigamy ang dalawang tao (kasal si boy sa una, si girl kabit) kahit wala naman silang anak at hindi sila kasal?
