Ano kaibahan ng Original Certificate of Title sa Transfer Certificate of Title? What is the difference between these?

Nakabili po ako ng lupa sa Lupi Camarines Sur at recently ko lang po nakuha ang titulo, ang issue ng register of deeds ay "ORIGINAL CERTIFICATE OF TITLE" na may tatak ng "SIPI NG MAYARI". Protected na po ba ng dokumentong ito ang aking lupa? Kasi po sa mga nakikita kong titulo ng lupa ay "TRANSFER CERTIFICATE OF TITLE", ano po ba ang kaibahan ng OCT at TCT?

Ang OCT ay isang titulo ng lupa na ipinapalabas matapos ang orihinal na registration ng isang piraso ng lupain sa ilalim ng Titulo Torrens. Ibig sabihin nito, ang lupang iyong nabili at nabili mo mula sa orihinal na nagpa-rehistro nito.

Ang TCT ay isang titulo ng lupa na ipinapalabas matapos na ang orihinal na rehistro ng lupa ay ilipat sa pangalan ng iba matapos itong ibenta, ipa-mana or dikaya't ipamahagi bilang donasyon.

Kung hindi peke ang OCT or TCT, ang taong bumibili ng lupa ay may karapatan at kalayaang pagtiwalaan ang mukha ng OCT or TCT. Kung magka-problema man at may maghabol laban sa OCT or TCT, kung ikaw ay innocent purchaser for value dahil sa ikaw ay walang kinalaman sa kahit na anupamang fraud patungkol sa original na pagpapa-rehistro nito, ikaw ay protektado.

Kapag halimbawa ang OCT ng iyong nabiling lupa ay nais mo nang ipalipat sa iyong pangalan, ang orihinal na lipi ng may-ari ay iyong isu-surrender sa Register of Deeds kasama ang Deed of Absolute Sale na ebidensiya noong bentahan ninyo ng lupa. Ang ilalabas na dokumento ng Register of Deeds sa pangalan mo ay isang Transfer Certificate of Title -- iyong OTC ay hindi na ibabalik pa sa iyo.
