Nawawalang Lot award certificate

Good morning po! Nakabili po kami ng lupa last 2009. Lot award po iyun. Wala po kaming nakuha na lot award cerificate kasi binaha daw po. Pero gumawa po kami ng kasulatan na binili namin yung lupa sa kanila. Ngayon po kinukuha po ng katabi namin bahay yung lupa namin ngayon. Ano pong pwede naming gawin? Possible po bang may record yung nabili naming lupa sa government? Paano po kami makakakuha ng kopya ng lot award certificate?

Kung tunay po na ang lupa ay isang awarded lot, ang alam ko, kapag ito'y awarded ng government through the NHA, bilang pabahay, may restrictions ito -- hindi ito puedeng ipag-bili sa loob ng ilang taon. Kasi po ang pabahay ng gobyerno kalimitan ay para sa mga urban poor at ito ay binabayaran nila sa murang halaga sa loob ng 15-25 years. Hindi po ito transferrable habang buhay ang awardee. So, hindi niya ito puedeng ipag-bili.

Kaya, kung ito'y pinagbili sa inyo, maaaring walang lot certificate talaga (dapat kasi ay bago ninyo ito binili, nag-verify muna kayo sa NHA or kaya sa kung anumang government agency na nagpamahagi noong lupa). O, tunay nga na may lot certificate pero ito'y nawala.

Kung inaangkin ng kapitbahay ninyo ang inyong lupa, baka naipagbili na rin sa kanila dati iyong lupa noong nagbenta din sa inyo (double sale). Hindi natin masasabi. Ang pinaka-maganda ay alamin ninyo kung ano ang pinanghahawakan nilang dokumento. Kasi, kung parepareho lang kayo na deed of sale or deed of assignment, dapat ay ipa-approve ninyo sa NHA o kung anumang ahensiya ng gobyerno ang nag-award nito para mailipat ang lot certificate sa inyong pangalan. Unahan ito.

Ngayon, hindi naman puedeng dalawang lots ang makuha ng isang awardee, so, baka tinatakot lamang kayo noong kapitbahay ninyo. Kumuha kayo ng abogado sa gayon, maprotektahan ninyo ang inyong mga karapatan.
