Hindi ibig sabihin dahil hindi ka nakatanggap ng subpoena ay hindi ka pwede kasuhan dahil nakadepende ito sa findings of probable cause na ayon sa krimen na ginawa mo at ikaw ay maaring may gawa nito. So if nasa fiscal pa rin ito maaring prescribe na kasi sabi mo 20 years ago na so mas madaling madismiss ito and of course if mag execute ng affidavit of desistance ang complainant. Kung sakaling ito naman ay sa korte na naifile normally may warrant of arrest ka narin nito. Maari pa ring itong madismiss pero kailangan pa po ng hearing dahil tanungin dapat ng judge ang complainant kung lubos po ka sa kanyang kalooban na idismiss na po ang kaso hindi dahil sa binayaran mo siya kundi dahil walang sapat na evidence at ang complaint laban sa iyo ay maybe a product of misunderstanding or ano pang valid reason na maipahayag ng lawyer po ninyo. You will not be cleared on this if your case will not be dismissed so you have to check sa status po ng kaso ninyo.
