Maari po bang bayaran ang bahay namin kapag giniba kahit hindi naman po amin lupa?

Halos 20 years na po kaming nakatira dito sa amin kaso ngayon lang po nagkakaangkinan at paghahati ang lupa ng mga magkakapatid na may ari nga raw po ng lupa kinatitirikan namin. Wala pa po itong titulo pero base sa sukat matatamaan po ang halos kalahati ng bahay namin if ever po possible po ba nilang gawin 'yun ayon sa batas natin? Mababayaran po kaya nila kami if ever na kuhanin or ipagiba kalahati ng bahay namin? Kung oo pwede niyo po ba ilahad or iattach kung saan po nakatala sa batas natin ito para po maipakita ko sa kanila. Marami pong salamat

If they can prove na sila talaga ang may ari kahit na wala pang titulo they have the right to demand you to remove the structure. However, if you can prove na builder in good faith din naman kayo dahil ninyo alam na you have exceeded at nuon paman alam na nila at may consent naman sa kanila na magtayo kayo sa kanilang property. Importante din dito na kayo mismo ay nagtayo sa lupaing pinaniniwalaang pag aari ninyo kaya lang hindi ninyo alam na sumubra lang at nag encroached sa lupain nila sa ganiton situation they will pay you sa if they choose na bilhin nalang ang bahay ninyo or maaring bayaran nalang ninyo ang lupaing kinatatayuan ninyo para huwag ng masira ang bahay.
Art. 448. The owner of the land on which anything has been built, sown or planted in good faith, shall have the right to appropriate as his own the works, sowing or planting, after payment of the indemnity provided for in Articles 546 and 548, or to oblige the one who built or planted to pay the price of the land, and the one who sowed, the proper rent. However, the builder or planter cannot be obliged to buy the land if its value is considerably more than that of the building or trees. In such case, he shall pay reasonable rent, if the owner of the land does not choose to appropriate the building or trees after proper indemnity. The parties shall agree upon the terms of the lease and in case of disagreement, the court shall fix the terms thereof.

Attorney sorry po just to clarify lang po ibig sabihin pwede pa rin po nila bayaran ang bahay dahil matagal na rin po kami dito at kapitbahay lang naman po namin ang may ari ng lupa?
