Ang bigamy ay public crime. Ibig sabihin ba nito ay pwedeng akong mag demanda sa taong gusto kong idemanda kahit hindi nya ako kamag anak? salamat po

Hindi po iyon ang ibig sabihin ng isang public crime. Ang ibig sabihin po ng "public" crime ay ito ay lumalabag sa mga kaugalian ng ating lipunan. Kasi po ang kasal ay isang institution na protektado ng estado ng Pilipinas. Kung ang isang kasal ay buwagin o wasakin ng isang tao, ang estado ng Pilipinas ay may karapatan na magsampa ng habla laban sa nagwasak ng kasal.
Kahit hindi nasaktan ang Pilipinas (ang asawa at anak noong nangalunya ang tunay na nasaktan), dahil sa ang Pilipinas ay interesado sa katiwasayan ng lahat ng mga kasalan sa loob ng bansa, may karapatan ang estado na ipag-sanggalang ang lahat ng mga batas patungkol sa kasalan.
Ang ibig sabihin lamang nito, ang estado ay puedeng magsampa ng habla laban sa nangangalunya kahit na walang habla ang asawa noong nangalunya. Maiging pakinggan, ano po?
Pero, realistically, saan naman kukuha ng ebidensiya ang estado upang magsampa ng kaso laban sa nangalunya kundi doon sa asawa at anak? So, bagamat theoretically, anyone including the police and the Prosecutor's Office can file a complaint for bigamy or concubinage, realistically, it isn't usually done. Kung hindi maghahabla ang asawa o mga anak noong nangalunya, hindi susulong ang habla.
