May tinubos kasi akong lupa sa bangko dahil naisangla ng pinsan ko mareremata na kay ako ang tumubos. Ako naman po ang nakapangalan sa resibo ng rural bank. Taong 1993 pa po ito natubos. Ngayon po gustong tubusin ng may ari pero same rate ng kung magkano ko tinubos ng taong 1993 sa bangko.
Ang naging problema ko naman po kahit may mga resibo ako galing sa rural bank at nasa akin po ang original tax December. Wala po naging kasulatan kung hanggang kelan niya lang pwede matubos at kung magkano ang interes na ipapatong.
Pwede po ba ako magdagdag kahit magkano gusto ko?
Pwede pa din po ba niya tubusin kahit matagal na panahon na to?
Pwede din po ba ako magbigay ng timeframe ngayon sa kanya kung hanggang kelan niya na lang ito pwede tubusin? Medyo matagal na po kasi at naiisipan ko na pagtayuan ng bahay

Dapat sana gumawa kayo ng kasulatan regarding your transaction with your pinsan hindi kasi pwede mag impose ng interest kung wala kayong agreement tungkol nito. Ang masasabi ko lang if after mo tinubos ito ikaw na ba yung nagpossess ng property? Ikaw din ba ang kumukuha sa mga fruits or other forms of income while in possession of the said property? If yes the said income will be served nalang as interest of your payment. However the parties by compromise agreement at this stage can very well make an agreement and it will depend na po sa gusto ng parties regarding the terms and conditions na gustong isulat ninyo. Regarding sa original Tax Declaration the owner can easily get a copy of it from assessors office except original title. So if possible try to talk to your cousin na gagawa nalang kayo ng panibagong agreement nito and dapat notarized po ito.
