Feeling ko yung perang pinapadala ko lang ang gusto nila dahil wala namang trabaho ang dati kong asawa. Kaya napagdesisyunan ko na kunin nlng ang mga anak ko at si mama na lang magaalaga sa kanila. Ano po dapat kong gawin?

Kailangan po ninyong magpetition sa korte nito maari kasing ito ay isang independent action o incident action. Ibig sabihin kung nagpafile kayo ng annulment or legal separation ang custody ng mga bata that the court will award ay magiging incident or part na sa decision. However, pwede namang tanging custody at support lang ang gusto ninyo ifile muna. So kailangan mo ng isang lawyer para tutulong sa iyo sa isyung ito. Since above 7 years old na ang mga bata maari na silang pumuli kung saan sila gustong sasama subject however sa approval ng korte. Maari kasing hindi aprobahan ng korte ang desisyon ng bata na sasama kung ang pinili niya ay unfit halimbawa addict, drunkard, may sakit sa utak ang pinili at marami pang iba na sa tingin ng korte ang best interest ng bata ay hindi maibigay sa magulang na pinili.

Under "Art. 176. of the Family Code, Illegitimate children shall use the surname and shall be under the parental authority of their mother, and shall be entitled to support in conformity with this Code. " Ibig sabihin na sa iyo dapat ang custody ng mga bata kaya pwede po ninyong ipaglaban ang karapatang ito pati na ang right of support ng iyong mga anak from his illegitimate father. Kailangan po ninyong magfile ng petition maari naman po kayong lumapit sa opisina ng PAO para sa libreng serbisyo o kaya kumuha ng isang private lawyer.
